The functions and facilities of this web site are only available to paid Members of Moi-Unlimited. Members purchase Vouchers to gain access. These Vouchers have a duration of 1 month, 3 months, 6 months or 1 year.
Please read the following Terms and Conditions thoroughly before registering as a Member with Moi-Unlimited. We ask you this to ensure that Moi-Unlimited continues to develop as a trustworthy and qualitatively high-principled site. Once you decide to become a Member of Moi-Unlimited, you agree that you accept these Terms and Conditions. You cannot join Moi-Unlimited if you do not accept these Terms and Conditions. To make use of the extensive facilities of this web site you must agree to the Terms and Conditions completely and without reservation. There is a selection box at the bottom of the registration page with the text “I am at least 18 years old and have read and understood the Terms and Conditions of Moi-Unlimited”. If you click on the box, then you acknowledge that you will be bound by all provisions that are found in the Terms and Conditions.

Article 1. Definitions

In these Terms and Conditions you will come across a number of words that begin with a capital letter. These words are defined below:

"Moi-Unlimited" refers to the complete facilities that are provided to enable personal, leisure time and non-business online meetings possible. Moi-Unlimited facilities can only be used with a valid Voucher.

"Voucher" refers to a specific fixed charge that allows complete access to the facilities of Moi-Unlimited for a specific period (1month, 3 months, 6 months or a year).

"Service(s)" refers to the complete facilities that are available to Members of Moi-Unlimited who are in the possession of a valid Voucher.

"Paid services" refers to the complete facilities that are available to Members of Moi-Unlimited who have a valid Voucher.

"Member" refers to the paid-up, validly registered user(s) of the Moi-Unlimited Services.

"Terms and Conditions" refers to this agreement.

"Alias" refers to your personal user name that can only be used for the Services of Moi-Unlimited. It is forbidden to publish, make available or share this with others. 
 
Article 2. Access and registration

2.1 Conditions for access and registration
You are solely responsible for the means (computer, software, telecommunication systems, etc.) that you use to access the Services. This applies also to the telecommunication costs that can be charged by your ISP for the use of Moi-Unlimited.

If you wish to become a member of Moi-Unlimited, you must be at least 18 years old and you must fill in all the compulsory fields in the registration form.

To become a Member of Moi-Unlimited you must first register and accept the Terms and Conditions that you find on the Moi-Unlimited site.

You guarantee that the information you provide is true and correct. You must inform Moi-Unlimited immediately of any changes in the registration details you supplied or you must modify your details, where necessary, on your own pages on the Moi-Unlimited site.
 
Once your registration has been accepted, you will receive a login name and a password. The login name and password are strictly personal and confidential and may not be disclosed or shared with others. If you make these details public or use them in a manner that is contrary to the purpose of this information, Moi-Unlimited will immediately terminate your account.

You are personally responsible for the use of your login details by third parties and for all actions that are taken and statements that are made via your account whether these are fraudulent or not. You agree to indemnify Moi-Unlimited against any claim of this kind. Since Moi-Unlimited is not required and does not have the facilities to control the identity of the registrant, Moi-Unlimited can not be held responsible for the use of your identity by another. If you have reason to believe that your login information or account is being used by a third party you must inform Moi-Unlimited immediately.

Should you wish to introduce a friend and to send their information to Moi-Unlimited, you should first obtain permission from them to allow Moi-Unlimited to process their information. This information will only be used to inform this friend about Moi-Unlimited and their services via an electronic message. The message will be sent in your name and on your account. You are the one who has supplied this personal information. In this manner you supply the particular information freely and openly and take responsibility for this.

From the point of view of security and quality, Moi-Unlimited will terminate your account when you have not used the dating service for a minimum of three months and no longer have a valid Voucher. The period of three months begins on the date that your Voucher expires.

2.2 Right to Terminate
You have the right to terminate your agreement within a period of seven calendar days from the date of acceptance. This can be done without penalty and without having to give a reason. Once you have made use of the Services of Moi-Unlimited you forfeit your right to terminate your agreement.
 
Article 3. Usage of Moi-Unlimited

After registration and the purchase of the required Voucher, you will be able to use the Services of Moi-Unlimited. The prices and terms of payment for the various Services can be found in the Article “Rates and Payment Conditions” in these Terms and Conditions. You can always check the current rates on the Moi-Unlimited web site at the moment that you require access to a specific Service.

3.1. Obligations of Moi-Unlimited
Moi-Unlimited offers an online dating service only via Internet solely using electronic means. It is not the aim of Moi-Unlimited to advise or act as a go-between for marriage or long relationships. The functions of Moi-Unlimited do not include arranging off-line meetings, providing access to the Internet or offering an electronic communications service. Further, Moi-Unlimited has no legal responsibility to establish the identity of Members when they access the Moi-Unlimited site or control the content placed on the site by the Members. As Moi-Unlimited does not have the technical capacity to deliver these services, Moi-Unlimited guarantees that they will not establish the identity of Members and will not modify the information that Members have entered under their own responsibility.

Moi-Unlimited cannot be held responsible for any untrue statements made by a Member. For this reason it is necessary to take precautions when you make arrangements to meet another Member. Moi-Unlimited can take no responsibility for meetings between you and other Members on the Moi-Unlimited web site or for meetings between Members and/or non-Members that result from the use of the Moi-Unlimited web site and the Services available there. Further it is recommended that a first meeting should be held in a public place (café, bar, restaurant etc.) where other people are present and that you inform others of where you will be.

In this connection, Moi-Unlimited would point out that you may not enter any information (such as: surname, e-mail address or telephone number) using any of the Services, which would enable other Members to identify you.

3.2 Obligations of the Member
The provisions of this Article are applicable without prejudice to what is described in the Article “Termination of membership”.
While using the Services you must comply with the contractural rights, the rights of third parties and these Terms and Conditions.

3.2.1. General obligations:
You have the following general obligations:
• Be honest and sincere in your dealings with Moi-Unlimited and other Members;
• Respect the intellectual ownership rights of the information delivered by Moi-Unlimited and by other Members;
• Acknowledge that you alone determine your privacy limits and that it is your responsibility to share only personal information with Moi-Unlimited and other Members that could not be construed as damaging.

3.2.2. Important obligations:
You have the following important obligations:
• It is forbidden use Moi-Unlimited for professional or commercial purposes, such as escort services, canvassing, inducement, trafficking in people or prostitution.
• It is forbidden to enter, distribute or send out incorrect or untrue information in any form;
• It is forbidden to make comments or spread information that infringes the rights of others. Further it is forbidden to enter anything that is libellous, offensive, obscene, injurious, or of such a nature that it could induce political, racist or xenophobic violence. In general it is forbidden to enter anything that conflicts with the objectives of Moi-Unlimited, with the current laws or standards of decency. In particular, photos, videos and all information, data or files that you provide must meet normal standards of decency and only relate to yourself or to a third party who has specifically given you permission to provide the information. You are personally responsible for the material as a Member of Moi-Unlimited.
• It is forbidden to enter personal information (e-mail address, postal address, telephone number etc.) on the Moi-Unlimited web site, so that members can make contact with each other outside Moi-Unlimited;
• It is forbidden to enter, distribute or send out information or content, in any form, with the intention of limiting, disturbing or making it impossible to use the Services in a normal manner. Further, it is forbidden to inhibit and/or slow the normal communications traffic by means of software, worms, viruses, logic bombs, mass mailings etc. Moi-Unlimited reserves the right to delete mass mailings sent by a Member to ensure the quality of the use of the Services by Members;
• It is forbidden to place, distribute or send out information or content in any form with links to other web sites which are illegal, do not meet normal standards of decency or conflict with the basic premises of Moi-Unlimited;
• Your password and login name must only be used for identification within the Services. You are not allowed to give out, make available or share your password and/or login name with others;
• You must guarantee that personal information in your area of the web site is given out legally, without risk of damage. For this reason you must obtain permission from other Members, within the related area, to receive an e-mail from Moi-Unlimited in the name of the Member; and
• Use the Services in agreement with and in the manner described in these Terms and Conditions.
Should you not abide by the Important obligations, as described above, this would be seen as a serious failing. Regardless of the provisions set out in the Article “Termination of membership”, Moi-Unlimited reserves the right to end the agreement and to delete your account(s) permanently should you violate one or more of these Important obligations.
 
Article 4. Rates and payment conditions

You can only use the services when you have a valid Voucher. You can buy a Voucher using a credit card or an on-line payment service.

You will find below the fees and the terms of payment for the Services of Moi-Unlimited. You can always see these on the Moi-Unlimited web site. They will always be displayed when you fill in the application for membership.

Moi-Unlimited reserves the right to modify the fees for Services, but will always inform you in good time. Modifications to the fees will be immediately displayed on the web site. The changes always come into force one month after the date of publication on the Moi-Unlimited web site.

For new Members, the changes come into force immediately after they have been published since, to become a Member, you must signify that you have accepted the Terms and Conditions. 

If you have purchased a Voucher before the date of change of the conditions then the original conditions will apply for the full term of the Voucher.

If your voucher has expired then you have up to 4 months – calculated from the date of change of the conditions and/or fees – to follow the procedure described in “Termination of membership”. If you have not taken any action during this period, it will be assumed that you have accepted the new Terms and Conditions.

Moi-Unlimited charges the following fees for a Moi-Unlimited Voucher:

The date of purchase of your Voucher is the same as the date of approval of the transaction.

You can terminate your Voucher whenever you choose by informing Moi-Unlimited. The termination occurs at the moment you inform Moi-Unlimited. Refunds are not given for any unused period that the Voucher was valid for. 

If you have chosen, when registering, for an automatic extension then the Voucher will be extended monthly for a period of one month. Should you let Moi-Unlimited know that you wish to end the voucher during the valid life of the voucher and within the specified period of notice, then the Voucher will not be extended further. The automatic monthly extension is charged at the monthly rate and using the payment method that was chosen when registering. 
 
Article 5. Privacy and protection of member data

It is possible that the ethnic origin, nationality, religion and/or sexual preferences of a Member could be established from specific information, comments or content (photos or videos) that Members choose, on their own responsibility and initiative, to publish. By publishing such, totally optional, information, you give, as Member, evidence of your intentions and declare consequently that you give, on your own responsibility, explicit agreement for Moi-Unlimited to process this ‘sensitive’ information. You accept, explicitly, the full responsibility for this.

Every Member can access or ask for access to the information relevant to him/her in order to modify the information, delete it or forbid Moi-Unlimited to make use of it, by filling in the Contact form (which can be found on the Moi-Unlimited web site). The Member must enter their personal identification accurately.

5.1. When and why do we collect information about you?
When you register with the dating service, play a game, fill in a survey, chat with other Members op purchase a voucher, you are asked for personal information. Specific information is required to access the Services.

5.2. What sort of information is asked for?
Whenever Moi-Unlimited asks for personal information it can be your name, house and e-mail address, telephone number (fixed or mobile), bank information, information about your appearance, photos, videos, your beliefs, religion, interests and the way you use the dating service.

In addition, it is possible that Members and other visitors could be asked to give general information, such as the browser being used (Netscape, Internet Explorer, etc.) and the version number, the operating system (Windows Vista, Mac Os, etc.) and the IP-address of the computer being used to visit us.

Moi-Unlimited also uses cookies to store information about Members during their use of the Moi-Unlimited web site. This allows you, as Member, to surf undisturbed, without having to re-type this information on every page. If you do not want cookies to be used you can modify the relevant options in your Internet browser. 

5.3. Who has access to the information about you?
The information that is collected when you register with Moi-Unlimited and subscribe to our Service is used to offer other Moi-Unlimited Services to you. Everything is done to protect our databases and ensure that your information is held in a safe environment. Only a small number of our staff have access to your information and then only when it is absolutely necessary. Apart from your personal advertisement and your profile, all information that you entered when registering is not available to third parties: it is not given out, sold or exchanged. Exceptions can be made in the situations described below. You are informed about them beforehand and you must agree that you do not object to them.

There is a possibility that we will send you special offers from our partners when you have given us explicit permission during registration. If you do not wish to receive the special offers from us or from our partners you can enter the fact on the Moi-Unlimited web site under “My Account” during or after registration.

Moi-Unlimited occasionally distributes general social demographic information (no names) to specific partners so that they can target their advertisements more accurately (in categories such as age, gender, etc.). In such situations, no information is given out that would allow your identity to be established.

The information in your personal advertisement and profile is available via the Moi-Unlimited web site. In addition, this information can be sent directly by Moi-Unlimited or by our partners in newsletters, on other web sites, via electronic (e-mail, SMS, etc.) or audio-visual (radio, television, etc.) means, or via the written press (newspapers, magazines, etc.) to people who are interested in Moi-Unlimited. By promoting your advertisement, selection criteria and your profile, you have a better chance of meeting someone.

You give Moi-Unlimited specific permission to duplicate and publish the information that is available in your personal advertisement, your selection criteria and profile (personal information, description, photos, videos, etc.) using all or a part of the Moi-Unlimited Services (Moi-Unlimited.com web site, Internet, e-mail) and/or more generally via all distribution media (such as press, radio, analogue television, digital television, cable or satellite) or via electronic communication (e-mail, Internet) over the whole world during the period that you as Member and Moi-Unlimited have an agreement as described in these Terms and Conditions. You also give Moi-Unlimited express permission to pass on the benefits of these rights to the partners and eventual successors to Moi-Unlimited.

If you no longer wish Moi-Unlimited or the partners of Moi-Unlimited to duplicate or distribute the information from your personal advertisement, selection criteria and profile, you can terminate the agreement under the conditions described in the Article “Termination of membership”. Due to the fact that this information is made up of the personal advertisement, the selection criteria and the profile of the Member, the information can only be removed when the next update or version of the communications (print, press, audio-visual or electronic) takes place following the termination of the voucher.

Article 6. Intellectual property

6.1 Content provided by Moi-Unlimited
The trade marks (including Moi-Unlimited.com®, and not excluding others) logos, images, photos, animations, videos and texts that are displayed on the Moi-Unlimited web site and in the Services, are the intellectual property of Moi-Unlimited or her partners and may not be duplicated, used or reproduced, on pain of legal action, without the express permission of Moi-Unlimited and her partners.

The user rights that that are granted to Members by Moi-Unlimited are strictly limited to the access, downloading, printing and copying of information to all media (fixed disk, floppy disk, cd-rom, etc.) and to the use of this information for private and personal purposes within the scope and during the period of Moi-Unlimited membership of the Member. You, as Member, are forbidden to use the information in any other manner without the agreement of Moi-Unlimited.

In particular, it is forbidden for you to modify, copy, duplicate, circulate, transfer, use commercially and/or distribute the Services, web pages of Moi-Unlimited and the software code of elements used to build the Moi-Unlimited Services and the site.

6.2 Content provided by Members
You give Moi-Unlimited a licence to use the intellectual property rights of the content that is provided by you with the object of distributing this content on the Moi-Unlimited web site.

This licence includes, in particular, the right of Moi-Unlimited to duplicate, reproduce, modify, translate, scan, set up for publicity purposes, commercial as well as non-commercial, by means of a sub-licence give or transfer content that relates to the Member (information, photos, videos, descriptions, selection criteria, etc.) via all or part of the Moi-Unlimited Services (on the Moi-Unlimited web site, via e-mail and via Autotel) and/or in mailings sent by Moi-Unlimited and, more generally, via all distribution media especially particular electronic communications media (e-mail, SMS, MMS, WAP, Internet, Cd-rom or DVD-rom) or audio-visual media (press, radio, analogue television, digital television, cable or satellite).

You give Moi-Unlimited express permission to modify the content to match the appearance of the Moi-Unlimited Services and/or any other communications media mentioned above, and/or to modify the content to match the technical requirements or correct media layouts. This right will be granted in general for the legal period for granted rights under European law and the current and future international agreements, including extensions that relate to the length of time that are mutually agreed. It is forbidden to copy, duplicate or, in any other way, make use of the information relating to other Members except for the use of the Services for your own personal and private purposes.

Article 7. Liability and warranty

7.1 Operation of the Moi-Unlimited web site and Services
In order to use the Services properly, you must have at your disposal the required hardware, software and parameters; Internet Explorer 6 or a similar Internet browser where JavaScript functions, cookies and pop-ups are set on.

You need to have knowledge of the hardware and software that is required for Internet usage and need to acknowledge that the properties and limitations of the Internet do not make it possible to give guarantees regarding the safety, availability and integrity of data processing via Internet.

Moi-Unlimited cannot guarantee that the Services will operate properly if a pop-up blocker is used. Such a program or function should be disabled before using the Services of our web site.

Moi-Unlimited does not guarantee that her Services will be able to be used if the Internet Service Provider of the Member cannot provide the Services in the correct manner. Moi-Unlimited can not be held in any way responsible for the non-functioning, non-availability or any other types of problems related to the use of the Moi-unlimited web site that are caused by errors in the software, problems with the Internet Service Provider, problems in the network or any other reasons which fall outside the area of influence of Moi Unlimited.

For this reason Moi-Unlimited cannot guarantee that the Services will operate without breaks or errors. The site will occasionally be taken down for maintenance, updates or technical improvements or to work on the improvement of the content en/of design. Moi-Unlimited will, when possible, inform you in advance of any maintenance work or updates.

7.2 Information and content supplied by Members
The information that you supply to Moi-Unlimited must be true and correct. The consequences of making the information public, on the lives of you and/or other Members, are exclusively the responsibility of the respective Member. You take the initiative for the publication and dissemination of personal information, data, text, content and images via Moi-Unlimited. For this reason you distance yourself from any possibility of redress from Moi-Unlimited, particularly on the grounds of possible damage to the image, the reputation or the privacy of the member, due to the distribution or publication of information about the Member under the provisions mentioned in these Terms and Conditions, in particular Article 5 “”Privacy and protection of Member data”.

Moi-Unlimited cannot be held responsible for the accuracy or inaccuracy of the information and content provided (and the consequences thereof) by Members and visitors to the web site. Neither can Moi-Unlimited be held responsible for the content provided by a Member that conflicts with the rights of one or more of the other Members or third parties.

The quality that is expected of the Moi-Unlimited dating service by both Moi-Unlimited and her Members makes it necessary for Members to conduct themselves and make statements that comply with specific ethical norms, to respect the rights of third parties and comply with the relevant laws. As a part of satisfying the demands of quality, individual responsibility and ethics, Moi-Unlimited makes it possible for Members to report, on the site, any data (photos, text, images), conduct or texts from a member which could possibly violate the appropriate laws, the image or objectives of the Moi-Unlimited Service, the rights of third parties or general norms and values. You acknowledge and accept that the data supplied by you, as well as your conduct and text when using the Service(s) can be remarked on by other Members and on the basis of an objective criteria check by Moi-Unlimited can be controlled and/or moderated. If a breach of the law or contractual obligation is discovered via a report or control then the provisions of the Conditions of Use and in particular the Article “Termination of membership” will be applied.

In the event that Moi-Unlimited is found liable for non-performance by a Member that results from the law or these Terms and Conditions, the Member will free Moi-Unlimited from all claims or damages against Moi-Unlimited, including, but not limited to, the complete compensation of costs, including the lawyer’s and court costs.

7.3 Links
Moi unlimited or third parties can display links to other web sites or to other sources on the Internet. Since Moi-Unlimited has no control over these external sites or sources, Moi-Unlimited can not be held responsible for the availability of them, nor for the content, advertisements, products, services or any other part of these external sites or sources. All problems that relate to a link should be reported to the administrator or web-master of the relevant site. You are reminded that by accessing or using external sites or sources, their own Terms and Conditions will apply.

If when performing a search assignment that is from the Moi-Unlimited web site, you arrive at sites, web pages or forums where the content conflicts with European law, you are advised to leave the respective site to avoid legal sanctions.

7.4 Limitation of responsibility
Moi-Unlimited can only be held responsible when incontrovertible evidence is presented in court to show that Moi-Unlimited has performed an unjust act and you have suffered damage or loss as a consequence. Moi-Unlimited can not be held responsible in any circumstances for the direct or indirect damage or loss of a Member, if the conduct of the Member has contributed, in any way, to the creation of the damage or loss that he/she claims to have suffered. Moi-Unlimited will, for example, not be responsible for any direct or indirect damage or loss you suffer if you have not complied or complied correctly with the Terms and Conditions.
 

Article 8. Termination of membership

You can terminate your registration with Moi-Unlimited whenever you choose, without reason, by using the appropriate page on the Moi-Unlimited web site. A termination is deemed to be valid from the first working day after Moi-Unlimited has received your request to terminate your registration. Any Voucher that you still have in your possession, at the termination of your membership, will not be refunded.

Regardless of the other provisions in the Terms and Conditions, Moi-Unlimited has the right to terminate your membership, without giving you notice, if you commit a serious breach of the Terms and Conditions. This termination has the same consequences as when you terminate your membership yourself.

Regardless of the other provisions in the Terms and Conditions, Moi-Unlimited has the right to terminate your account if you have violated the provisions of the agreement and have taken no action to correct this within seven days of receiving an e-mail from Moi-Unlimited asking you to comply with the Terms and Conditions.

Such a termination does not affect the right of Moi-Unlimited to claim any damage or losses sustained from the Member and/or his/her accredited and lawful representative(s), in compensation for any damage or loss sustained due to such breaches of contract.

You will receive confirmation of the termination of your account by e-mail. Personal information will be deleted at your request or at the expiration of the statutory specified period following the termination of your account.

Article 9. Agreement between Member and Moi-Unlimited

These Terms and Conditions and the pages on the Moi-Unlimited web site that relate to these Terms and Conditions form an agreement where the relationship between you, as Member, and Moi-Unlimited is established. These provisions take precedence over and replace all earlier provisions, even if these earlier conditions have not been explicitly withdrawn or modified, and constitute the entire rights and responsibilities of Moi-Unlimited and yourself.

If a condition of these Terms and Conditions is found to be invalid in law or by a definite ruling of a court of law, all other provision of these Terms and Conditions will remain in force. Further, should one party to this agreement neglect to take action in case of a breach of the Terms and Conditions by the other party, this should not be seen as a renunciation of the right of the first mentioned party to take action by future breaches of the Terms and Conditions.
 
Article 10. Additions by Moi-Unlimited on the Terms and Conditions

Moi-Unlimited can make modifications to these Terms and Conditions at any time. Once the changes have been placed on the Moi-Unlimited web site, you will be informed of the nature of the modifications. The modifications will come into force one month after being placed on the Moi-Unlimited web site.

The Member can find himself in the following situations.
10.1 The period for which the voucher was purchased is still open:
In this situation you may demand that the Terms and Conditions in force at the time of purchase of the Voucher remain in force until the end of the Voucher period.

10.2 The period for which the voucher was purchased has elapsed:
In this situation you have the right, as Member, to use the procedures described in the Article “Termination of membership” within four months following the date that the new Terms and Conditions come into force. After this period of four months the new Terms and Conditions are considered to be accepted, unless you have made clear that you wish to terminate the agreement. You are therefore asked to read the most recent version on-line on the Moi-Unlimited web site.

Article 11. Applicable law

For these Terms and Conditions, European law is applicable. In the case of a disagreement regarding the meaning of a concept or provision of these Terms and Conditions, the English version will take precedence.

Moi-Unlimited® is owned by Boyztoyz International B.V. in The Netherlands. The servers holding the Moi-Unlimited.com web site run in protected data-centres.
